PRIVACY POLICY

This Privacy Policy ("Policy") describes how Bright Spark Society LLC ("Bright Spark Society," "we," "us," or "our") collects, uses, discloses, and protects information obtained through our website located at www.brightsparksociety.com (the "Site"). By accessing or using the Site, you ("you" or "User") agree to this Privacy Policy. If you do not agree with this Policy, please do not use the Site.

Please note: Bright Spark Society is preparing to launch. Some features and data practices described in this Policy are not yet active and will apply only once the relevant features go live.

Article 1 — Definitions

  1. Aggregate Information. Information that has been combined with information about other users and analyzed or evaluated as a whole, such that no specific individual may be reasonably identified.

  2. Cookies. Small data files placed on your device by a website that enable certain features and functionality.

  3. Personal Information. Information that identifies, relates to, describes, or is reasonably capable of being associated with or linked to a particular individual, including but not limited to name, email address, postal address, telephone number, and payment information. (A) Social security number; (B) Driver’s license number or state identification card number; (C) Account number, credit card number, or debit card number, if circumstances exist wherein such a number could be used without additional identifying information, access codes, or passwords; (D) Account passwords or personal identification numbers or other access codes; or (E) Any of the items contained in subparagraphs (A) through (D) of this paragraph when not in connection with the individual’s first name or first initial and last name, if the information compromised would be sufficient to perform or attempt to perform identity theft against the person whose information was compromised. The term “personal information” does not include publicly available information that is lawfully made available to the general public from federal, state, or local government records.

  1. Site. The website is operated by Bright Spark Society LLC and located at www.brightsparksociety.com , including all subdomains and related services.

  2. Usage Information. Information collected automatically about your use of the Site, including IP address, browser type, device identifiers, pages viewed, access times, and referring URL.

Article 2 — Information We Collect

  1. Personal Information You Provide. 

    1. Voluntary Submission. We collect Personal Information that you voluntarily provide to us when you create an account, submit contact forms, subscribe to our newsletters or otherwise voluntarily provide such information. 

    2. Categories of Personal Information. The categories of Personal Information we may collect include: 

      1. Identifiers. Name, Email, ZIP code, Number of children in your household, the ages of the children in your household.

      2. Commercial Information. Membership and account information, purchase history, transaction details.

      3. Financial Information. Payment card information, billing.

      4. Communication Content. Messages sent through contact forms or customer service inquiries.

    3. Account Registration. If you create an account on the Site, we collect your username, password, email address, and any other information you choose to provide in your profile. Some features, such as member accounts, may not be available until a later date.

    4. Newsletter Subscription. If you subscribe to our newsletter or email communications, we collect your email address and any preferences you indicate.

  2. Information Collected Automatically. 

    1. Usage Information. When you access or use the Site, we automatically collect Usage Information, including: 

      1. Device information (device type, operating system, unique device identifiers).

      2. Browser information (browser type, version, language preference).

      3. Log information (IP address, access times, pages viewed, referring and exit pages).

      4. Location information (general geographic location derived from IP address).

    2. Cookies and Similar Technologies. We may in the future use cookies, web beacons, pixel tags, and similar tracking technologies to collect information about your browsing activities. 

    3. Third-Party Analytics. We may in the future use third-party analytics services  to help us understand how users engage with the Site. These services may use cookies and similar technologies to collect Usage Information on our behalf.

    4. Advertising and Marketing Technologies.  We may use third-party advertising networks and marketing platforms, including google ads, Facebook pixel or other online/social media marketing platform, to deliver targeted advertisements and measure campaign effectiveness.

  3. Information from Third Parties. 

    1. Third-Party Platforms. If you access the Site through a third-party platform or social media service (e.g., Facebook, Google, LinkedIn), we may receive information from that platform in accordance with your privacy settings on that platform.

    2. Business Partners. We may receive information about you from our business partners, affiliates, marketing vendors, or other third parties.

    3. Payment Processors. We use third-party payment processors to process payments. These processors collect payment information directly from you and may share transaction confirmation data with us.

  4. Children's Privacy. 

    1. Age Restriction. The Site is not directed to children under the age of 13. We do not knowingly collect Personal Information from children under 13 years of age. Bright Spark Society LLC (collectively “BSS”) is committed to protecting the privacy of children who use our websites and apps. This policy is in accordance with the U.S. Children’s Online Privacy Protection Act (“COPPA”). BSS does not knowingly collect, solicit, or maintain any Personal Information submitted from children under the age of 13. If BSS discovers that a child under the age of 13 has submitted Personal Information, BSS will delete the information as quickly as possible. If User is under age 13, and would like to use BSS's website, please ask a parent or guardian for assistance. If Users believe that BSS might have any information from or about a child under 13, or if Users have any questions about BSS's treatment of children’s Personal Information, contact Owner using the information provided in this policy.   1. Parental Notice. If we learn that we have collected Personal Information from a child under age 13 without parental consent, we will delete that information as quickly as possible. If you believe that a child under 16 may have provided us with Personal Information, please contact us at kelsey@brightsparksociety.com.

Article 3 — How We Use Your Information

  1. Purposes of Use. We use the information we collect for the following purposes: 

    1. Provide and Maintain the Site. To operate, maintain, and improve the Site and its features; to provide customer support; and to respond to your inquiries.

    2. Process Transactions. To process payments, fulfill orders, and send you transaction confirmations and receipts.

    3. Communications. To communicate with you about the Site, including sending administrative messages, updates, security alerts, and support messages.

    4. Marketing and Promotional Materials. To send you newsletters, promotional materials, and other information about our products, services, and events, in accordance with your communication preferences.

    5. Personalization. To personalize your experience on the Site, including displaying content tailored to your interests and preferences.

    6. Analytics and Improvement. To analyze usage trends, track Site performance, and improve our products, services, and user experience.

    7. Security and Fraud Prevention. To detect, prevent, and respond to security incidents, fraud, illegal activity, and violations of our terms of service.

    8. Legal Compliance. To comply with applicable laws, regulations, legal processes, and governmental requests.

    9. Business Operations. To facilitate mergers, acquisitions, or sale of assets; to enforce our agreements; and to protect our rights and property.

    10. Consent-Based Processing. For any other purpose for which you provide consent or that we disclose at the time of collection.

  2. Legal Basis for Processing. We process your Personal Information on the following legal bases: performance of a contract with you; compliance with legal obligations; protection of vital interests; our legitimate business interests; and your consent, where required by law.

Article 4 — How We Share Your Information

  1. Service Providers and Business Partners. We may share your information with third-party service providers, contractors, and business partners who perform services on our behalf, including: 

    1. Hosting and Infrastructure Providers. Companies that host our Site and store data.

    2. Payment Processors. Third-party payment processors such as Square, Stripe that facilitate transactions.

    3. Analytics and Advertising Partners. We may in the future utilize these partners to  help us analyze Site usage and deliver targeted advertising.

    4. Email and Communication Services. MailerLite, which helps us send newsletters and promotional communications.

    5. Customer Support Tools. We will in the future use Customer relationship management and support platforms, such as Salesforce.

    6. Other Service Providers. Vendors providing professional services such as legal, accounting, auditing, and consulting services.

  2. Business Transfers. If Bright Spark Society is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify you via email or prominent notice on the Site before your information is transferred and becomes subject to a different privacy policy. 

  3. Legal Requirements and Protection of Rights. We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court, government agency, or law enforcement). We may also disclose information to: 

    1. Enforce our terms of service, policies, or user agreements.

    2. Protect the rights, property, or safety of Bright Spark Society, our users, or the public.

    3. Detect, prevent, or address fraud, security issues, or technical problems.

    4. Respond to claims that content violates the rights of third parties.

  4. Aggregate and De-Identified Information. We may share Aggregate Information or de-identified information that cannot reasonably be used to identify you with third parties for research, marketing, analytics, and other purposes. 

  5. With Your Consent. We may share your information with third parties when you have given us your explicit consent to do so. 

  6. Sale or Sharing of Personal Information. We do not sell or share your Personal Information with third parties for their direct marketing purposes. 

Article 5 — Your Privacy Rights and Choices

  1. Access and Correction. You have the right to request access to the Personal Information we hold about you and to request correction of inaccurate or incomplete information. To exercise this right, please contact us at kelsey@brightsparksociety.com.

  2. Deletion. You may request that we delete your Personal Information, subject to certain exceptions (e.g., information necessary to complete a transaction, comply with legal obligations, or detect security incidents). To request deletion, contact us at kelsey@brightsparksociety.com. 

  3. Opt-Out of Marketing Communications. You may opt out of receiving promotional emails from us by following the unsubscribe instructions in those emails or by contacting us at kelsey@brightsparksociety.com. Please note that even if you opt out of marketing communications, we may still send you non-promotional messages related to your account or our ongoing business relationship. 

  4. Cookie Preferences. You may control or delete cookies through your browser settings. Most browsers allow you to refuse cookies or alert you when cookies are being sent. Please note that if you disable cookies, some features of the Site may not function properly.

  5. Do Not Track. Some browsers have a 'Do Not Track' feature that lets you tell websites that you do not want to have your online activities tracked. Our Site does not currently respond to 'Do Not Track' signals. 

  6. California Privacy Rights. If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to: 

    1. Know what Personal Information we collect, use, disclose, and sell or share.

    2. Request deletion of your Personal Information.

    3. Opt out of the sale or sharing of your Personal Information.

    4. Correct inaccurate Personal Information.

    5. Limit the use and disclosure of sensitive Personal Information.

  8. Right to Non-Discrimination. We will not discriminate against you for exercising any of your privacy rights. 

Article 6 — Data Security

  1. Security Measures. We implement reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, use, disclosure, alteration, and destruction. 

  2. No Guarantee of Security. Despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against interception or misuse. We cannot guarantee the absolute security of your information. 

  3. User Responsibility. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately of any unauthorized use of your account. 

Article 7 — Data Retention

  1. Retention Period. We retain your Personal Information for as long as necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required or permitted by law. Factors affecting retention periods include: 

    1. The length of time you maintain an account with us.

    2. Whether you have requested deletion of your information.

    3. Legal, regulatory, tax, or accounting requirements.

    4. Our legitimate business needs, including fraud prevention, security, and legal compliance.

  2. Deletion. When we no longer need your Personal Information, we will securely delete or anonymize it in accordance with our data retention and destruction policies. 

Article 8 — Third-Party Links and Services

  1. Third-Party Websites. The Site may contain links to third-party websites, applications, or services that are not owned or controlled by Bright Spark Society. This Policy does not apply to those third-party sites. We are not responsible for the privacy practices or content of third-party websites. 

  2. User Responsibility. We encourage you to review the privacy policies of any third-party websites or services you visit or use. Your interactions with third-party websites are governed by their respective privacy policies. 

Article 9 — International Users

  1. Data Transfer. The Site is operated in the United States. If you are accessing the Site from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States or other countries where our service providers operate. Data protection laws in the United States and other countries may differ from those in your country of residence. 

  2. Consent to Transfer. By using the Site, you consent to the transfer of your information to the United States and other countries as described in this Policy. 

Article 10 — Changes to This Privacy Policy

  1. Right to Modify. We reserve the right to update or modify this Policy at any time to reflect changes in our practices, technology, legal requirements, or other factors. When we make changes, we will update the "Effective Date" at the top of this Policy. 

  2. Notice of Material Changes. If we make material changes to this Policy, we will notify you by sending an email to the address associated with your account. 

  3. Continued Use. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Policy. We encourage you to review this Policy periodically.
